Subtitle 14. Nursing Homes [- Civil Money Penalties].
19-1410.
(A) THE DEPARTMENT SHALL MAKE A SITE VISIT AND CONDUCT A FULL
SURVEY OF EACH LICENSED NURSING HOME AT LEAST FOUR TWO TIMES PER
CALENDAR YEAR
(B) THE DEPARTMENT MAY WAIVE THE REQUIREMENTS OF SUBSECTION (A)
OF THIS SECTION FOR A NURSING HOME THAT, IN THE TWO MOST RECENT SURVEYS
OF THE NURSING HOME CONDUCTED AFTER OCTOBER 1, 2000, HAS HAD NO
DEFICIENCIES THAT HAVE THE POTENTIAL FOR MINIMUM HARM OR GREATER
(B) (C) ALL SURVEYS SHALL BE UNANNOUNCED.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 2000.

AN ACT concerning
Nursing Homes - Quality of Care Oversight
FOR the purpose of establishing an Oversight Committee on Quality of Care in
Nursing Homes; specifying the membership of the Oversight Committee;
specifying the duties of the Oversight Committee; requiring the Office of Health
Care Quality of the Department of Health and Mental Hygiene to report to the
Oversight Committee twice annually; requiring the Oversight Committee to
make certain recommendations and to take into account and examine certain
issues; requiring the Secretary of the Department of Aging to chair the
Oversight Committee; requiring the Deputy Secretary of Health Care Financing
to report annually to the Oversight Committee: requiring the Department of
Aging to provide staff support for the Oversight Committee; requiring the
Oversight Committee to submit a certain report to the Governor and General
Assembly on or before a certain date; providing for the termination of the
Oversight Committee; and generally relating to the Oversight Committee on
Quality of Care in Nursing Homes.
