5-101.
(a) In this title the following words have the meanings indicated.
[(b) "Director" means the Director of the Office of Planning,
(c) "Office" means the Office of Planning.]
(B) "DEPARTMENT" MEANS THE DEPARTMENT OF PLANNING.
(C) "SECRETARY' MEANS THE SECRETARY OF PLANNING.
Subtitle 2. Organization of [Office] DEPARTMENT and General Authority of
[Director] SECRETARY.

There is an Office of Planning, established as a separate unit of State
government.]
[5-202.
(a) The head of the Office is the Director of Planning, who shall be appointed
by the Governor with the advice and consent of the Senate.
(b) The Director must have:
(1) training or experience in State, regional, or local planning; or
(2) significant civic, governmental, or business experience in matters
connected with urban or rural planning.
(c) Before taking office, the appointee shall take the oath required by Article I,
§ 9 of the Maryland Constitution.
(d) (1) The Director serves at the pleasure of the Governor and is
responsible directly to the Governor. The Director shall advise the Governor of all
matters assigned to the Office and is responsible for carrying out the Governor's
policies on those matters.
(2) The Director is responsible for the operation of the Office and shall
establish guidelines and procedures to promote the orderly and efficient
administration of the Office. The Director may establish, reorganize, or abolish areas
of responsibility in the Office as necessary to fulfill the duties assigned to the
Director.
(3) The Director is responsible for establishing policy to be followed by
the units in the Office.
(4) The Director is a member of the Governor's Executive Council.
(e) The Director is entitled to the salary provided in the State budget.]
