of employment not authorized in the fiscal
2001 budget shall be subject to the State
Finance and Procurement Article, Section
7-236 and the Rule of 50.

|
Further provided that the Maryland
Department of Transportation may
create and fill an additional 47
authorized positions above the ceiling
of 9.205.5 which shall not count
against the rule of 50 if:
(1) Senate Bill 811 or House Bill 1248
amending the Mass Transit
Administration's (MTA) farebox
recovery requirement is enacted;
and
(2) The Maryland Department of
Transportation demonstrates to the
budget committees that the
positions are necessary to expand
MTA bus services consistent with
any farebox recovery legislation
enacted during the 2000 legislative
session, and the budget committees
have 45 days to review and
comment on the proposal.
It is the intent of the General Assembly that
funds dedicated to the Transportation
Trust Fund shall he applied to purposes
bearing direct relation to the State
transportation program, unless directed
otherwise by legislation. To implement
this intent for the Maryland Department
of Transportation in fiscal 2001, no
commitment of funds in excess of
$250,000 may be made nor may such an
amount be transferred, by budget
amendment or otherwise, for any project
or purpose not normally arising in
connection with the ordinary ongoing
operation of the department and not
contemplated in the budget approved or
the last published Consolidated
Transportation Program without review
and comment by the budget committees.
