In subsection (c)(1) of this section, the reference to "an inmate" is added to
state expressly that which was only implied in the former law.

GENERAL REVISOR'S NOTE TO SUBTITLE:

The Correctional Services Article Review Committee notes, for consideration by
the General Assembly, that throughout this subtitle, references to a "court" have been
substituted for former references to a "judge" to clarify that the source law is referring
to a power or duty of the court rather than power or duty of an individual judge. No
substantive changes are intended.

SUBTITLE 8. MISCELLANEOUS.
11-801. WEEKEND INMATES. 

(A) "WEEKEND INMATE" DEFINED. 

IN THIS SECTION, "WEEKEND INMATE" MEANS AN INMATE SENTENCED TO A
LOCAL CORRECTIONAL FACILITY FOR NONCONSECUTIVE PERIODS OF 48 HOURS OR
LESS PER WEEK.

(B)  AUTHORITY OF COUNTY TO IMPOSE FEE.

THE GOVERNING BODY OF A COUNTY MAY IMPOSE ON AND COLLECT FROM A
WEEKEND INMATE A REASONABLE FEE IN AN AMOUNT NOT TO EXCEED THE
AVERAGE COST OF PROVIDING FOOD, LODGING, AND CLOTHING FOR AN INMATE FOR
THE TIME THE INMATE IS CONFINED IN THE LOCAL CORRECTIONAL FACILITY.

(C) PROCEDURES.

IF THE GOVERNING BODY OF A COUNTY IMPOSES A FEE UNDER THIS SECTION,
THE GOVERNING BODY SHALL ADOPT STANDARD PROCEDURES TO IMPLEMENT THIS
SECTION, INCLUDING A PROCEDURE FOR THE WAIVER OF A PART OR ALL OF THE FEE
BASED ON THE ABILITY OF AN INMATE TO PAY THE FEE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 645GG, except as it related to the definition
of "[l]ocal detention center".

In subsection (b) of this section, the phrase "for the time the inmate is
confined in the local correctional facility" is added to state expressly that
which was only implied in the former law, i.e., the fee should reflect "the
average cost of providing food, lodging, and clothing for an inmate" for the
period in which the inmate is confined.

In subsection (c) of this section, the word "imposes" is substituted for the
former phrase "decides to impose" for brevity.
