(1) IN ADDITION TO ANY OTHER DEDUCTIONS ALLOWED UNDER THIS
SUBTITLE, AN INMATE MAY BE ALLOWED A DEDUCTION OF NOT MORE THAN 5 DAYS
FROM THE INMATE'S TERM OF CONFINEMENT FOR EACH CALENDAR MONTH OR
PORTION OF A CALENDAR MONTH OF PRESENTENCE OR POSTSENTENCE
CONFINEMENT DURING WHICH AN INMATE MANIFESTS SATISFACTORY INDUSTRY,
APPLICATION, AND PROGRESS IN SPECIAL SELECTED WORK PROJECTS OR OTHER
SPECIAL PROGRAMS.
(2) THE DEDUCTION DESCRIBED IN PARAGRAPH (1) OF THIS
SUBSECTION SHALL BE CALCULATED FROM THE FIRST DAY THAT AN INMATE IS
ASSIGNED A PROJECT OR PROGRAM.
(B) DESIGNATION BY MANAGING OFFICIAL.
THE MANAGING OFFICIAL OF A LOCAL CORRECTIONAL FACILITY SHALL
DESIGNATE THE PROJECTS AND PROGRAMS THAT MAKE AN INMATE ELIGIBLE FOR
DIMINUTION CREDITS UNDER THIS SECTION.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 704A(f).
In subsection (a)(1) of this section, the reference to deductions that are "[i]n
addition to any other deductions allowed under this subtitle" is substituted
for the former reference to "additional" deductions to state expressly that
which was only implied in the former law.
Also in subsection (a)(1) of this section, the reference to a calendar month
or portion of a calendar month of "presentence or postsentence
confinement" is added to state expressly that which was only implied in
the former law, i.e., an inmate is allowed deductions under this section for
time served in both presentence and postsentence confinement. No
substantive change is intended.
Also in subsection (a)(1) of this section, the reference to an inmate's "term
of confinement" is substituted for the former reference to the inmate's
"period of ... commitment or sentence" for consistency throughout this
article. See General Revisor's Note to this article.
In subsection (a)(2) of this section, the reference to "calculating] [the
deduction] from the first day that an inmate is assigned a project or
program" is substituted for the former vague reference to the deduction
"commencing on the first day of assignment" for clarity.
In subsection (b) of this section, the reference to projects and programs
"that make an inmate eligible for diminution credits under this section" is
substituted for the former reference to "[s]uch" projects and programs for
clarity.
