11-309. SAME — ACQUISITION, CONSTRUCTION, AND RENOVATION.

(A) STATE SHARE.

THE STATE SHALL PAY ALL OF THE APPROVED ACQUISITION, CONSTRUCTION,
AND RENOVATION COSTS, INCLUDING ARCHITECTURAL SERVICES AND CAPITAL
EQUIPMENT, IN EXCESS OF AVAILABLE FEDERAL FUNDS.

(B) REGULATIONS.

WITH THE APPROVAL OF THE BOARD OF PUBLIC WORKS, THE SECRETARY
SHALL ADOPT REGULATIONS THAT SPECIFY WHICH COSTS ARE APPROVED COSTS.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 710B(a).

In subsection (a) of this section, the former reference to a center that is
"acquired, constructed, or renovated pursuant to § 710(b), (d), (e), or (f) and
in accordance with this section" is deleted as implicit in the reference to a
"center". 

In subsection (b) of this section, the former requirement that regulations
be adopted "in accordance with Title 10, Subtitle 1 of the State
Government Article" is deleted as implicit in the requirement to adopt
regulations. All Executive Branch units must comply with Title 10,
Subtitle 1 of the State Government Article, which sets forth the
requirements governing the proposal and adoption of regulations,
including publication in the Maryland Register and review by the Joint
Committee on Administrative, Executive, and Legislative Review.

11-310. SAME — OPERATION.

(A) STATE SUBSIDY — IN GENERAL.

(1) SUBJECT TO SUBSECTION (B) OF THIS SECTION, THE STATE SHALL
ENTER INTO AN AGREEMENT WITH THE COUNTY OR COUNTIES IN A REGION TO
PROVIDE A STATE SUBSIDY TO PAY ALL APPROVED OPERATING COSTS FOR A CENTER
THAT EXCEED THE SUM OF AVAILABLE FEDERAL FUNDS AND INMATE
CONTRIBUTIONS FOR ROOM AND BOARD.

(2) WITH THE APPROVAL OF THE BOARD OF PUBLIC WORKS, THE
SECRETARY SHALL ADOPT REGULATIONS THAT;

(I) SPECIFY WHICH COSTS ARE APPROVED OPERATING COSTS; AND

(II) INCLUDE AS APPROVED OPERATING COSTS ALL REASONABLE
OPERATING EXPENSES NECESSARY TO ENSURE THAT A CENTER MEETS THE
MINIMUM STANDARDS ADOPTED BY THE SECRETARY UNDER § 11-305 OF THIS
SUBTITLE.
