The Correctional Services Article Review Committee notes, for
consideration by the General Assembly, that the meaning of the term
"engineering question" in subsection (a)(1) and (2) of this section is unclear.
The General Assembly may wish to clarify the meaning of this term. See
also § 10-103 of this subtitle and accompanying Revisor's Note.

The Correctional Services Article Review Committee also notes, for
consideration by the General Assembly, that subsection (a)(3) of this
section does not explicitly allow the Department to "disapprove" a design
or service. The General Assembly may wish to fill this gap.

10-103. SAME — SECRETARY.

A CONTRACT, PLAN, DESIGN, OR SPECIFICATION FOR CONSTRUCTION OF A
STATE CORRECTIONAL FACILITY THAT INVOLVES AN ENGINEERING QUESTION IS
SUBJECT TO THE APPROVAL OF THE SECRETARY.

REVISOR'S NOTE: This section formerly was Art. 41, § 4-104.1(a)(3).

10-104. DEPARTMENTAL INSPECTIONS.

(A) INSPECTION AND EVALUATION.
THE DEPARTMENT SHALL:

(1) INSPECT AND APPROVE OR DISAPPROVE THE MATERIAL,
EQUIPMENT, AND METHODS USED TO CONSTRUCT A STATE CORRECTIONAL
FACILITY; AND

(2) INSPECT THE STATE CORRECTIONAL FACILITY DURING THE COURSE
OF CONSTRUCTION.

(B) DUTIES — ARCHITECT OR ENGINEER

THE DUTY OF THE DEPARTMENT UNDER THIS SECTION DOES NOT RELIEVE AN
ARCHITECT OR ENGINEER OF A SUPERVISORY RESPONSIBILITY FOR WHICH THE
ARCHITECT OR ENGINEER IS EMPLOYED.
