(III) FROM ANY AVAILABLE FUND THAT MAY BE USED TO PAY THE
HOSPITAL EXPENSES OF AN INMATE IN THE CORRECTIONAL FACILITY.
(2) IF MONEY IS NOT AVAILABLE UNDER ANY OF THE SOURCES
IDENTIFIED IN PARAGRAPH (1) OF THIS SUBSECTION TO PAY THE SPECIFIED
EXPENSES:
(I) THE COUNTY FROM WHICH THE INMATE WAS COMMITTED IS
RESPONSIBLE FOR PAYMENT OF THE EXPENSES; AND
(II) THE MANAGING OFFICIAL OF THE CORRECTIONAL FACILITY TO
WHICH THE INMATE WAS COMMITTED SHALL COLLECT PAYMENT IN ACCORDANCE
WITH TITLE 16 OF THE HEALTH - GENERAL ARTICLE.
(E) DISPOSITION OF CHILD.
(1) AFTER RECEIVING PROOF FROM THE FATHER OR OTHER RELATIVE
OF THE CHILD OF THE ABILITY TO PROPERLY CARE FOR THE CHILD, THE DIVISION
OF CORRECTION MAY ORDER THAT THE FATHER OR OTHER RELATIVE TAKE
CUSTODY OF THE CHILD.
(2) THE FATHER OR OTHER RELATIVE OF THE CHILD THAT RECEIVES
CUSTODY UNDER PARAGRAPH (1) OF THIS SUBSECTION SHALL MAINTAIN AND CARE
FOR THE CHILD AT THE FATHER'S OR OTHER RELATIVE'S EXPENSE UNTIL THE
INMATE IS RELEASED FROM THE CORRECTIONAL FACILITY OR THE CHILD, AS
PROVIDED BY LAW, IS ADOPTED.
(3) IF THE FATHER OR OTHER RELATIVE OF THE CHILD IS UNABLE TO
PROPERLY MAINTAIN AND CARE FOR THE CHILD, THE DIVISION OF CORRECTION
SHALL PLACE THE CHILD IN THE CARE OF THE DEPARTMENT OF HUMAN
RESOURCES.
REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 699.
The Correctional Services Article Review Committee notes, for
consideration by the General Assembly, that this section does not apply to
inmates in the Patuxent Institution, the Baltimore City Detention Center,
or local correctional facilities. The General Assembly may wish to make
this section applicable to such inmates or establish separate procedures
relating to the handling of pregnant inmates in those facilities.
Throughout this section, the defined term "inmate" is substituted each
time for the former reference to "woman" for consistency within this
section and throughout this article and because only women become
pregnant and give birth.
In subsections (a) and (c) of this section, the former references to the birth
of "a child" and "such child" are deleted as implicit in the references to a
"birth".
