9-511. INMATES ASSIGNED TO ROAD WORK BY GOVERNOR — DUTY TO GUARD,
TRANSPORT, AND PROVIDE CARE.

(A) IN GENERAL.

THE DIVISION OF CORRECTION SHALL PROVIDE, OR MAKE ARRANGEMENTS
THAT IT CONSIDERS TO BE ADEQUATE AND PROPER TO PROVIDE, FOR THE
GUARDING, TRANSPORTING/LODGING, FEEDING; CLOTHING, AND MEDICAL AND
OTHER CARE OF INMATES WHILE THE INMATES ARE WORKING ON PUBLIC ROADS
UNDER §§ 9-508 THROUGH 9-514 OF THIS SUBTITLE.

(B) REGULATIONS.

THE DIVISION OF CORRECTION MAY ADOPT REGULATIONS AS NECESSARY TO
CARRY OUT §§ 9-508 THROUGH 9-514 OF THIS SUBTITLE.

(C) PAYMENT OF EXPENSES.

(1) FOR INMATES ASSIGNED TO THE STATE HIGHWAY ADMINISTRATION
UNDER § 9-509 OF THIS SUBTITLE, THE STATE SHALL PAY THE EXPENSES INCURRED
UNDER SUBSECTION (A) OF THIS SECTION.

(2) FOR INMATES ASSIGNED TO A MUNICIPAL CORPORATION OR
COUNTY UNDER § 9-510 OF THIS SUBTITLE, THE MUNICIPAL CORPORATION OR
COUNTY SHALL PAY THE EXPENSES INCURRED UNDER SUBSECTION (A) OF THIS
SECTION UNDER ARRANGEMENTS MADE WITH, OR SATISFACTORY TO, THE DIVISION
OF CORRECTION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 723.

In subsection (a) of this section, the former reference to medical "attention"
of inmates is deleted as unnecessary in light of the comprehensive
reference to "medical and other care".

In subsection (b) of this section, the former reference to "rules" and
regulations is deleted for consistency throughout this article. See General
Revisor's Note to this article.

Also in subsection (b) of this section, the former reference to regulations
that are "proper" is deleted as unnecessary in light of Title 10, Subtitle 1 of
the State Government Article, which sets forth comprehensive rules
governing the adoption of regulations.
