In subsection (a) of this section, the defined term "correctional facility" is
substituted for the former reference to a "correctional institution" for
consistency with terminology used throughout this article. See General
Revisor's Note to this article.
Also in subsection (a) of this section, the reference to an "individual" is
substituted for the former references to a "person" because only human
beings, and not the other types of entities included in the defined term
"person", can engage in the types of activities that are listed in that
subsection. See § 1-101 of this article for the definition of "person".
The introductory language to former Art. 27, § 337A(a) is deleted as
unnecessary because the former definition of "correctional employee" is
merged into subsection (a) of this section as part of the substantive
provision.

8-808. SALE OF PRODUCE BY CORRECTIONAL FACILITIES.
(A) PROHIBITED.
AN AGENT OR EMPLOYEE OF A STATE CORRECTIONAL FACILITY OR ANY OTHER
CORRECTIONAL FACILITY THAT RECEIVES STATE AID MAY NOT RAISE OR TAKE PART
IN THE RAISING OF PERISHABLE VEGETABLE PRODUCE FOR SALE UNLESS THE SALE
IS TO BE MADE TO ANOTHER STATE UNIT, AN INSTITUTION RECEIVING STATE AID,
OR A CANNERY.
(B) PENALTY.
A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT TO A FINE OF NOT LESS THAN $50 AND NOT MORE THAN
$100.
(C) REMOVAL.
AN EMPLOYEE OF A STATE CORRECTIONAL FACILITY WHO VIOLATES THIS
SECTION IS SUBJECT TO REMOVAL.
