(2) IF A SUPERVISEE FAILS TO PAY FOR DRUG OR ALCOHOL ABUSE
TESTING AS REQUIRED BY THE DIVISION OF PAROLE AND PROBATION, THE
COMMISSION MAY REVOKE PAROLE OR MANDATORY SUPERVISION.

(3) IF THE DIVISION OF PAROLE AND PROBATION DETERMINES THAT
ANY OF THE CRITERIA SPECIFIED IN SUBSECTION (D) OF THIS SECTION ARE
APPLICABLE, THE DIVISION MAY EXEMPT A SUPERVISEE WHOLLY OR PARTLY FROM
A PAYMENT FOR DRUG OR ALCOHOL ABUSE TESTING.

(H) GUIDELINES; INVESTIGATION.

THE DIVISION OF PAROLE AND PROBATION SHALL:

(1) ADOPT GUIDELINES FOR COLLECTING THE SUPERVISION FEE;

(2) ADOPT GUIDELINES FOR COLLECTING THE COST OF DRUG AND
ALCOHOL ABUSE TESTING; AND

(3) INVESTIGATE REQUESTS FOR AN EXEMPTION FROM PAYMENT IF
THE COMMISSION REQUESTS AN INVESTIGATION.

(I) RECORDS; REPORT.

THE DIVISION OF PAROLE AND PROBATION SHALL:

(1) KEEP RECORDS OF ALL PAYMENTS BY EACH SUPERVISEE; AND

(2) REPORT DELINQUENCIES TO THE COMMISSION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 41, § 4-519.

In subsection (b) of this section, the former phrase "whenever an inmate is
placed under the supervision of the Division of Parole and Probation" is
deleted as included in the defined term "supervisee".

In subsection (d)(3) of this section, the reference to a "disability" is
substituted for the former, antiquated reference to a "handicap".

In subsection (f)(2) of this section, the reference to a violation "of the fee
requirement" is added to state expressly that which was formerly only
implied in the reference to a "violation".

Subsection (g)(2) of this section is revised using language that is consistent
with subsection (f)(2) of this section.

In subsection (h)(1) of this section, the reference to the "supervision" fee is
added to state expressly that which was formerly only implied in the
reference to the "fee".

In subsection (h)(2) of this section, the reference to the cost of drug and
alcohol "abuse" testing is added for consistency with subsection (g) of this
section.
