REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 41, § 4-612{b) and (c).

In subsections (a) and (b) of this section, the references to an "individual"
are substituted for the former references to a "person" because only a
human being, and not the other entities included in the defined term
"person", can be eligible for mandatory supervision. See § 1-101 of this
article for the definition of "person".

In subsection (a) of this section, the former reference to an individual being
"deemed" to remain in legal custody is deleted as surplusage.

Defined terms: "Mandatory supervision" § 7-101
"Parolee" § 7-101

7-503. WRITTEN ORDER; RESTITUTION.

(A) WRITTEN ORDER

THE DIVISION OF CORRECTION SHALL ISSUE A WRITTEN ORDER THAT
SPECIFIES THE TERMS AND CONDITIONS THAT MUST BE MET FOR AN INDIVIDUAL
ON MANDATORY SUPERVISION TO SERVE THE REMAINDER OF THE INDIVIDUAL'S
TERM OUTSIDE A CORRECTIONAL FACILITY.

(B) RESTITUTION.

IF A COURT PREVIOUSLY ORDERED AN INDIVIDUAL TO PAY RESTITUTION AS A
PART OF A SENTENCE OR AS A CONDITION OF PROBATION, THE INDIVIDUAL SHALL
BE REQUIRED TO MAKE RESTITUTION PAYMENTS WHILE UNDER MANDATORY
SUPERVISION AS A CONDITION OF MANDATORY SUPERVISION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 41, § 4-612(a).

In subsections (a) and (b) of this section, the references to an "individual"
are substituted for the former references to a "person" because only a
human being, and not the other entities included in the defined term
"person", can be eligible for mandatory supervision. See § 1-101 of this
article for the definition of "person".

In subsection (a) of this section, the reference to the "Division of
Correction" is added to state expressly that which was only implied in the
former law, i.e., the Division of Correction is the entity that is responsible
for issuing the written order.

Also in subsection (a) of this section, the former reference to serving the
remainder of the individual's term outside "the confines of" a correctional
facility is deleted as implicit in the reference to serving the remainder of
the individual's term "outside" a correctional facility.

Defined terms: "Correctional facility" § 1-101
"Division of Correction" § 1-101
"Mandatory supervision" § 7-101
