(3) ARREST OFFENDERS IN THE PROGRAM AS AUTHORIZED UNDER
ARTICLE 27, § 594B OF THE CODE.

(B) QUALIFICATIONS OF EMPLOYEES.

A PAROLE AND PROBATION EMPLOYEE WHO IS AUTHORIZED TO MAKE ARRESTS
UNDER THIS SECTION SHALL:

(1) MEET THE MINIMUM QUALIFICATIONS REQUIRED BY THE
MARYLAND POLICE TRAINING COMMISSION; AND

(2) COMPLETE SATISFACTORILY THE TRAINING PRESCRIBED BY THE
MARYLAND POLICE TRAINING COMMISSION.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 41, § 4-601(c) and (d).

In the introductory language of subsection (a) of this section, the former
reference to "certain" employees is deleted as surplusage.

In subsection (a)(1) of this section, the reference to "offenders" is
substituted for the former reference to "alleged parole violators" for
consistency with § 7-502(b) of this article, which provides that "[a]n
individual on mandatory supervision is subject to all laws, rules,
regulations, and conditions that apply to parolees".

Also in subsection (a)(1) of this section, the former reference to the
execution of warrants for the retaking of offenders "in accordance with §
4-602A of this subtitle" is deleted as surplusage because former Art. 41, §
4-602A, which is revised in § 6-108 of this subtitle, did not relate to the
execution of warrants for the retaking of offenders.

In subsection (a)(2) of this section, the reference to "search" warrants is
added to state expressly that which was only implied in the former
reference to "warrants" and for consistency with § 6-109 of this subtitle.

In subsection (a)(3) of this section, the former reference to the Director
authorizing certain employees to "[h]ave the power to" arrest offenders is
deleted as unnecessary in light of the reference, in the introductory
language of subsection (a) of this section, to the Director "authoriz[ing]" the
employees to arrest offenders.

In subsection (b)(2) of this section, the reference to "satisfactorily"
completing training prescribed by the Maryland Police Training
Commission is added to state expressly that which was only implied in the
former law and for consistency with former Art. 41, § 4-602A(j). See §
6-108 of this subtitle and accompanying Revisor's Note.
