REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 700(k)(1).

The reference to diminution credits that were "awarded" is substituted for
the former reference to diminution credits that were "allowed" for
consistency with §§ 3-709 and 11-507 of this article.

Former Art. 27, § 700(k)(2), which provided that this section does not apply
to future credits, is deleted as unnecessary. By its terms, former Art. 27, §
700(k)(l), which is revised in this section, did not apply to diminution
credits earned following an inmate's return to the Division of Correction.

SUBTITLE 8. LEAVE.
3-801. WORK-RELEASE PROGRAM — IN GENERAL.

(A) AUTHORITY TO ESTABLISH.

THE DIVISION MAY ESTABLISH A WORK-RELEASE PROGRAM.

(B) PURPOSE.

UNDER THE WORK-RELEASE PROGRAM, AN INMATE WHO IS SENTENCED TO
THE JURISDICTION OF THE DIVISION MAY BE GRANTED THE PRIVILEGE OF LEAVING
ACTUAL CONFINEMENT DURING NECESSARY AND REASONABLE HOURS:

(1) TO WORK AT GAINFUL PUBLIC OR PRIVATE EMPLOYMENT;

(2) TO ATTEND SCHOOL; OR

(3) UNDER APPROPRIATE CONDITIONS, TO SEEK EMPLOYMENT.

(C) INMATE'S APPLICATION.

(1) AN INMATE MAY APPLY TO THE WARDEN OF THE CORRECTIONAL
FACILITY IN WHICH THE INMATE IS CONFINED FOR PERMISSION TO PARTICIPATE IN
THE PROGRAM.

(2) AN APPLICATION SHALL INCLUDE:

(I) A STATEMENT BY THE INMATE THAT THE INMATE AGREES TO
ABIDE BY ALL TERMS AND CONDITIONS OF THE PARTICULAR PLAN THAT THE
COMMISSIONER OR THE COMMISSIONER'S DESIGNEE ADOPTS FOR THE INMATE;

(II) THE NAME AND ADDRESS OF A PROPOSED EMPLOYER OR
SCHOOL TRAINING PROGRAM, IF ANY; AND

(III) ANY OTHER INFORMATION THAT THE DIVISION OR THE
COMMISSIONER REQUIRES, INCLUDING THE INMATE'S AGREEMENT TO WAIVE THE
RIGHT TO CONTEST EXTRADITION PROCEEDINGS.
