SUBTITLE 4. HOME DETENTION PROGRAM.

3-401. "PROGRAM" DEFINED.

IN THIS SUBTITLE, "PROGRAM" MEANS A HOME DETENTION PROGRAM
ESTABLISHED UNDER THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 27, § 689A(a)(l), (2), "and (4).

Former Art. 27, § 689A(a)(2), which defined "Commissioner", is deleted in
light of § 3-101 of this article to the same effect.

3-402. HOME DETENTION AUTHORIZED.

WITH THE SECRETARY'S APPROVAL, THE COMMISSIONER MAY ESTABLISH A
HOME DETENTION PROGRAM UNDER WHICH AN INMATE IN THE CUSTODY OF THE
COMMISSIONER MAY LIVE IN A PRIVATE DWELLING THAT THE COMMISSIONER OR
THE COMMISSIONER'S DESIGNEE APPROVES.

change from former Art. 27, § 689A(b).

3-403. METHODS OF SUPERVISION.

AN INMATE IN THE PROGRAM SHALL BE SUPERVISED BY MEANS OF:

(1) ELECTRONIC DEVICES; AND

(2) DIRECT CONTACT BY EMPLOYEES OF THE DIVISION.

change from former Art. 27, § 689A(c).

3-404. ELIGIBILITY.

AN INMATE IS NOT ELIGIBLE FOR THE PROGRAM IF THE INMATE:

(1) IS SERVING A LIFE SENTENCE;

(2) HAS BEEN FOUND GUILTY OF A CRIME OF VIOLENCE AS DEFINED IN
ARTICLE 27, § 643B OF THE CODE UNLESS:
