Similarly, the references to a "correctional facility" are substituted for the
former references to an "institution". See General Revisor's Note to this

In subsection (a) of this section, the former reference to "departmental"
policies is deleted as obsolete. The former "Department of Correctional
Services" was reorganized as the "Division of Correction" in 1970. See
General Revisor's Note to this subtitle. Correspondingly, in subsection
(b)(3) of this section, the reference to the "Division" is substituted for the
former reference to "Department".

Also in subsection (a) of this section, the former reference to a warden or
administrator being in "sole" charge of a facility is deleted as inconsistent
with other provisions of this subtitle. See, e.g., § 3-203(a) of this subtitle,
which specifies that the Commissioner is "in charge" of the units in the
Division.

Also in subsection (a) of this section, the former reference to policy being
. established "from time to time" is deleted as surplusage.

Also in subsection (a) of this section, the reference to "the correctional
facility to which ... appointed" is substituted for the former reference to
"his institution" for clarity.

In subsection (b)(3) of this section, the reference to "directives" of the
Division is substituted for the former reference to "orders" for consistency
with current terminology used by the Division. The Division currently
issues "Division of Correction Directives", not "orders". The use of the term
"directive" is also consistent with the fourth sentence of former Art. 41, §
4-105(a), which referred to "directives". See General Revisor's Note to this
subtitle.

3-212. SAME — ANNUAL REPORTS.

(A) IN GENERAL.

ON OR BEFORE SEPTEMBER 30 OF EACH YEAR, EACH WARDEN SHALL SUBMIT
TO THE COMMISSIONER A REPORT AND STATEMENT ON THE AFFAIRS OF THE
CORRECTIONAL FACILITY TO WHICH THE WARDEN IS APPOINTED.

(B) CONTENTS.

(1) THE REPORT SHALL INCLUDE THE INFORMATION REQUIRED UNDER
§ 3-207(A) OF THIS SUBTITLE AS IT RELATES TO THE CORRECTIONAL FACILITY.

(2) THE STATEMENT SHALL INCLUDE THE INFORMATION REQUIRED
UNDER § 3-207(B) OF THIS SUBTITLE AS IT RELATES TO THE CORRECTIONAL
FACILITY.
