SUBTITLE 2. GENERAL PROVISIONS.

1- 201. VERIFICATION.

A REQUIREMENT IN THIS ARTICLE THAT A DOCUMENT BE VERIFIED MEANS
THAT THE DOCUMENT SHALL BE VERIFIED BY A DECLARATION MADE UNDER THE
PENALTIES OF PERJURY THAT THE MATTERS AND FACTS CONTAINED IN THE
DOCUMENT ARE TRUE TO THE BEST OF THE KNOWLEDGE, INFORMATION, AND
BELIEF OF THE INDIVIDUAL MAKING THE DECLARATION.

REVISOR'S NOTE: This section is new language added for consistency with
other revised articles of the Code. See, e.g., FI § l-202(b) and EN §
1-201(a).

Throughout this article, the requirement that a document be "verified" is
substituted for the former requirements that a document be "signed and
sworn to" or be "sworn to". See, e.g., §§ 3-206(b) and 4-203(d)(3) of this
article.

TITLE 2. DEPARTMENT OF PUBLIC SAFETY AND CORRECTIONAL SERVICES.
SUBTITLE 1. DEPARTMENT ESTABLISHED.

2- 101. ESTABLISHED.

THERE IS A DEPARTMENT OF PUBLIC SAFETY AND CORRECTIONAL SERVICES
ESTABLISHED AS A PRINCIPAL DEPARTMENT OF THE STATE GOVERNMENT.

REVISOR'S NOTE: This section is new language derived without substantive
change from the first sentence of former Art. 41, § 4-101(a).

It is set forth as a separate section for emphasis.

government.

2-102. SECRETARY.

(A) POSITION AND APPOINTMENT.

(1) WITH THE ADVICE AND CONSENT OF THE SENATE, THE GOVERNOR
SHALL APPOINT THE SECRETARY OF PUBLIC SAFETY AND CORRECTIONAL SERVICES.

(2) THE SECRETARY IS THE HEAD OF THE DEPARTMENT.

(B) OATH.

BEFORE TAKING OFFICE, THE APPOINTEE SHALL TAKE THE OATH REQUIRED
BY ARTICLE I, § 9 OF THE MARYLAND CONSTITUTION.

(C) RESPONSIBILITY TO GOVERNOR

(1) THE SECRETARY SERVES AT THE PLEASURE OF THE GOVERNOR AND
IS RESPONSIBLE DIRECTLY TO THE GOVERNOR
