"DIVISION OF PAROLE AND PROBATION," MEANS THE DIVISION OF PAROLE AND
PROBATION IN THE DEPARTMENT OF PUBLIC SAFETY AND CORRECTIONAL
SERVICES.

REVISOR'S NOTE: This subsection is new language added to avoid repetition of
the full reference to the "Division of Parole and Probation in the
Department of Public Safety and Correctional Services".

(I) INMATE.

"INMATE" MEANS AN INDIVIDUAL WHO IS ACTUALLY OR CONSTRUCTIVELY
DETAINED OR CONFINED IN A CORRECTIONAL FACILITY.

REVISOR'S NOTE: This subsection is new language added to provide
 uniformity throughout this article when referring to an individual who is

actually or constructively detained or confined in a correctional facility.

The comprehensive term that is defined by this subsection is used
throughout this article as a substitute for former references to "felon",
"convict", "prisoner", "persons confined", and various other similar terms.

Defined term: "Correctional facility" § 1-101

(J) LOCAL CORRECTIONAL FACILITY.

"LOCAL CORRECTIONAL FACILITY" MEANS A CORRECTIONAL FACILITY THAT IS
OPERATED:

(1) BY ONE OR MORE COUNTIES; OR

(2) BY A MUNICIPAL CORPORATION.

REVISOR'S NOTE: This subsection is new language derived without
substantive change from former Art. 41, § 4-401(b)(6) and former Art. 27,
§§ 645GG(a)(2), 700-I(a)(3), 705(a)(1), 645R, as it defined "jail", and
704A(a), except as it referred to the Baltimore City Detention Center.

Although these former provisions applied only to particular subtitles and
sections, they are revised to apply throughout this article.

The former reference to correctional facilities "within the State of
Maryland" is deleted as implicit in the reference to "correctional
facilities]".

The former reference to a correctional facility that is "primarily" operated
by a county or municipality is deleted as surplusage.

Defined term: "Correctional facility" § 1-101

(K) MANAGING OFFICIAL.

"MANAGING OFFICIAL" MEANS THE ADMINISTRATOR, DIRECTOR, WARDEN,
SUPERINTENDENT, SHERIFF, OR OTHER. INDIVIDUAL RESPONSIBLE FOR THE
MANAGEMENT OF A CORRECTIONAL FACILITY.
