2. assure the availability of competent services to the public;

and

(ii) the number of exemptions granted under this subsection has
not tended to erode the purposes of subsection (b) of this section or other provisions of
this title.

(2) (i) The Ethics Commission may grant an exemption under
paragraph. (1) of this subsection only:

1. in extraordinary situations; and

2. upon the recommendation of the Governor, at the request
of the executive unit involved.

(ii) The Ethics Commission shall apply this subsection as
consistently as possible under similar facts and circumstances.

(D-1) AN OFFICIAL OR EMPLOYEE MAY NOT ACCEPT A GIFT THAT IS
PROHIBITED UNDER § 13-211 OF THE STATE FINANCE AND PROCUREMENT ARTICLE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 1999.

Dear Mr. Speaker:

In accordance with Article II Section 17 of the Maryland Constitution, I have today
vetoed House Bill 1153.

This bill repeals the September 30, 1999 termination date for current law providing
that a home health agency accredited by an organization approved by the Department
of Health and Mental Hygiene (DHMH) is deemed to meet State licensure standards.

Senate Bill 773, which was passed by the General Assembly and signed by me on May
13, 1999, accomplishes the same purpose. Therefore, it is not necessary for me to sign
House Bill 1153.
