ECONOMIC DEVELOPMENT, ENVIRONMENTAL PROTECTION, AND OTHER POLICY
CONSIDERATIONS THAT THE BOARD CONSIDERS RELEVANT.

(F) (1) AT ANY TIME FOLLOWING THE PUBLIC HEARING, BUT WITHIN 6
MONTHS OF THE DATE OF THE PETITION, THE BOARD SHALL RENDER A FINAL
DECISION ON THE APPLICATION APPEAL.

(2) THE BOARD MAY AFFIRM, REVERSE, OR MODIFY THE DECISION OF
THE ADMINISTRATION ON THE COST OF THE RIGHT OF ACCESS FROM WHICH THE
PROPERTY OWNER APPEALED.

(3) IF THE BOARD GRANTS A RIGHT OF ACCESS, THE BOARD SHALL MAY
INCLUDE THE TERMS OF THE SALE RELATED TO THE COST OF THE RIGHT OF ACCESS
IN ITS DECISION ON THE COST OF THE RIGHT OF ACCESS AND THE TERMS
GOVERNING THE SALE OF ACCESS RIGHTS
.

(4) A DECISION BY THE BOARD UNDER THIS SUBSECTION:

(I) SHALL BE BASED ON THE RECORD DEVELOPED BY THE BOARD;

(II) SHALL REQUIRE THE AFFIRMATIVE VOTE OF AT LEAST TWO
MEMBERS OF THE BOARD; AND

(III) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, SHALL BE
BINDING ON THE ADMINISTRATION, BUT SUBJECT TO APPROVAL OF THE BOARD OF
PUBLIC WORKS.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 1999.

Dear Mr. Speaker:

In accordance with Article II, Section 17 of the Maryland Constitution, I today vetoed
House Bill 1012 - Public Service Commission - Funding and Personnel.

House Bill 1012 provides the Public Service Commission (PSC) with the authority to
determine the compensation for attorneys in the Office of General Counsel, license
hearing officers, professional and management service personnel, accountants,
auditors, and engineers. The bill also creates a nonlapsing Public Service Commission
Fund to fund the operations of the PSC, establishing the PSC as a special fund
agency.

There can be no doubt that the industries regulated by the Public Service Commission
are undergoing fundamental and rapid changes. A stable and qualified workforce is
certainly necessary in this dynamic environment. However, while some flexibility in
salary-setting authority may be advisable, I object to the unnecessary step of
