fiduciary institution letters of administration issued by or under the direction or
supervision of the court or an officer of the court;

(v) The Department of Human Resources requests the financial
record in the course of verifying the individual's eligibility for public assistance; or

(vi) The institution received a request or subpoena for information
DIRECTLY from the Child Support Enforcement Administration of the Department of
Human Resources under § 10-108,2 or § 10-108.4 of the Family Law Article OR
INDIRECTLY THROUGH THE FEDERAL PARENT LOCATOR SERVICES SERVICE UNDER
42 U.S.C. § 666(A)(17); and

(2) Shall disclose any information requested in writing by the
Department of Human Resources relative to moneys held in a savings deposit, time
deposit, demand deposit, or any other deposit held by the fiduciary institution in the
name of the individual who is a recipient or applicant for public assistance.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1999.

(Senate Bill 509)

AN ACT concerning

Diesel Vehicle Emissions Control Program

FOR the purpose of requiring the Secretary of the Environment, the Secretary of the
State Police, and the Secretary of Transportation to jointly establish by
regulation a Diesel Vehicle Emissions Control Program; providing for certain
fines collected for certain violations to be rem
itted to the Department of
Transportation and credited to the Transportation Trust Fund under certain
circumstances;
providing for the admissibility of certain evidence in certain
court proceedings; establishing certain prima facie evidence of certain emissions
standards under certain circumstances; providing for the payment of certain
expenses of the Commercial Vehicle Enforcement Division of the Department of
State Police under certain circumstances; requiring the Secretary of the
Environment, the Secretary of the State Police, and the Secretary of
Transportation to jointly adopt regulations to implement, administer, regulate,
and enforce certain provisions of law under certain circumstances; requiring
certain regulations to establish certain requirements for certain emissions
standards, emissions tests, emissions test equipment, emissions test procedures,
and certain circumstances under which a test may be performed, and providing
an opportunity to administratively appeal certain findings under certain
circumstances
; establishing certain consent for and obligation to submit to
emissions testing under certain circumstances; establishing certain penalties;
