SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Tax - General

11-206.

(H) THE SALES AND USE TAX DOES NOT APPLY TO THE SALE THROUGH A
VENDING MACHINE OF MILK, BOTTLED WATER, FRESH FRUIT, FRESH VEGETABLES,
OR YOGURT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
July 1, 1999.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 25.

This bill makes the prohibition against using prestige of office for personal gain, or
the gain of another, applicable to all State officials, including members of the General
Assembly.

House Bill 2, which was passed by the General Assembly and signed by me on May
27, 1999, accomplishes the same purpose. Therefore, it is not necessary for me to sign
Senate Bill 25.

Senate Bill 25

AN ACT concerning

Ethics Law - Use of Prestige of Office

FOR the purpose of making applicable to all State officials the provision of the
Maryland Public Ethics Law that prohibits the intentional use of the prestige of
office or public position for the official's private gain or that of another, subject to
an exception for the performance of usual and customary constituent services;
providing for the application of this Act; and generally relating to standards of
conduct under the Maryland Public Ethics Law; and making this Act an
emergency measure
.
