AN ACT concerning

Alcoholic Beverages - Interstate Shipment - Felony

FOR the purpose of making it a felony for certain persons in or from another state to
ship alcoholic beverages to certain persons in the State who do not have a
certain license or permit; clarifying that this offense includes certain shipments
of alcoholic beverages ordered or purchased through a computer network;
providing certain penalties; and generally relating to the interstate sale of
alcoholic beverages.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 2B - Alcoholic Beverages

16-506.1.

(A) (1) A PERSON IN THE BUSINESS OF SELLING OR DISTRIBUTING
ALCOHOLIC BEVERAGES IN OR FROM ANOTHER STATE MAY NOT SHIP, CAUSE TO BE
SHIPPED, OR DELIVER ALCOHOLIC BEVERAGES DIRECTLY TO A RECIPIENT WHO IS
UNDER THE AGE OF 21 YEARS IN THIS STATE IF THE SELLER, DISTRIBUTOR, SHIPPER,
TRANSPORTER, OR RECIPIENT DOES NOT HOLD THE REQUISITE LICENSE OR PERMIT
UNDER THIS ARTICLE.

(2) THE PROHIBITION UNDER PARAGRAPH (1) OF THIS SUBSECTION
INCLUDES ALCOHOLIC BEVERAGES THAT ARE ORDERED OR PURCHASED THROUGH A
COMPUTER NETWORK.

(B) A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A FELONY AND ON
CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING $1,000 OR IMPRISONMENT NOT
EXCEEDING 2 YEARS OR BOTH.
