AN ACT concerning

Higher Education - University System of Maryland - Coordination,

Governance, and Funding

FOR the purpose of authorizing the Maryland Higher Education Commission and the
Board of Regents of the University System of Maryland to distribute certain
incentive funding to certain institutions under certain circumstances; altering
the role of the Commission in reviewing the operating and capital budgets of the
University System of Maryland; clarifying the duties of the University System of
Maryland; requiring the Commission to ensure that the State Plan for Higher
Education complies with certain requirements of State and federal law; altering
the role of the Commission in the review of mission statements developed by
public institutions of higher education; altering the requirements for the
contents of mission statements and requiring the Commission, with the
assistance of the presidents of certain institutions, to establish and periodically
update the format of mission statements; reestablishing the College
Intervention Preparation Program to raise the level of academic preparedness of
disadvantaged students who go on to college; exempting a student member of the
Board of Regents who is a student in good academic standing at the University of
Maryland University College from a certain requirement; altering the
governance and management of the University System of Maryland and
establishing the University as a public corporation with certain powers and
responsibilities; requiring the Board of Regents to delegate certain authority to
certain presidents under certain circumstances; requiring the Board of Regents
to develop certain policies on standards of operation and accountability;
requiring the Board of Regents to include members of the Boards of Visitors in
certain activities; requiring the Board of Regents to adopt a certain policy by a
certain date to govern the public ethics of members of the Board of Regents;
providing the president of the University of Maryland, College Park with the
opportunity to meet with the Governor to present the University's budget
request at a certain time; clarifying that the presidents have the authority to
appoint institutional boards; exempting the University System of Maryland and
Morgan State University from certain provisions of the State procurement law;
altering the requirements of an overall plan for the University System of
Maryland to include certain priorities, goals, and duties; requiring the Board of
Regents of the University System of Maryland and the Board of Regents of
Morgan State University, subject to review and approval by the Board of Public
Works and the Administrative, Executive, and Legislative Review Committee, to
