AN ACT concerning
State Police Officers - Keeping State-Issued Sidearm Handgun on
Retirement
FOR the purpose of authorizing a State Police officer, upon retirement in good
standing, to keep or acquire the sidearm handgun issued to that officer by the
State if the officer reimburses the Department of State Police for the current
market replacement value of the sidearm handgun in value or trade and the
Secretary of the State Police authorizes the transaction; requiring the Secretary
of State Police to adopt certain regulations; providing for the application of this
Act; and generally relating to the authority for State Police officers to keep their
State-issued sidearms handguns upon retirement,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 88B - Department of State Police
24A.
(A) NOTWITHSTANDING ANY OTHER PROVISION OF LAW, A STATE POLICE
OFFICER, UPON RETIREMENT IN GOOD STANDING, MAY KEEP THE SIDEARM OR
ACQUIRE THE HANDGUN ISSUED TO THAT OFFICER BY THE STATE IF:
(1) THE OFFICER REIMBURSES THE DEPARTMENT FOR THE CURRENT
MARKET VALUE OF THE SIDEARM IN VALUE OR TRADE REPLACEMENT VALUE OF
THE HANDGUN; AND
(2) THE SECRETARY AUTHORIZES THE TRANSACTION.
(B) THE SECRETARY SHALL ADOPT REGULATIONS NECESSARY TO CARRY OUT
THIS SECTION.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall be
construed retroactively and shall be applied to and interpreted to affect a State Police
Officer who retired on or after July 1, 1998, for whom the handgun that was issued
remains available for acquisition.
SECTION 2. 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 1999.
