(i) the licensed cosmetologist is sponsored by a beauty salon that
holds a beauty salon permit; and
(ii) the patron is a customer of the beauty salon.]
(B) (1) IN THIS SUBSECTION THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.
(I) "ASSISTED LIVING FACILITY" HAS THE MEANING STATED IN §
19-1801 OF THE HEALTH—GENERAL ARTICLE.
(II) "FUNERAL ESTABLISHMENT" HAS THE MEANING STATED IN §
7-101(H) OF THE HEALTH OCCUPATIONS ARTICLE.
(III) "HOSPICE FACILITY" HAS THE MEANING STATED IN § 19-901(C)
OF THE HEALTH - GENERAL ARTICLE.
(IV) "HOSPITAL" HAS THE MEANING STATED IN § 19-301(F) OF THE
HEALTH - GENERAL ARTICLE.
(V) "NURSING FACILITY" HAS THE MEANING STATED IN § 19-1401(D)
OF THE HEALTH - GENERAL ARTICLE.
(2) SUBJECT TO PARAGRAPH (3) OF THIS SUBSECTION, A LICENSED
COSMETOLOGIST, BY APPOINTMENT, MAY PRACTICE COSMETOLOGY ON AN
INDIVIDUAL WHO:
(I) IS CONFINED IN AN ASSISTED LIVING FACILITY, COMMUNITY
CARE HOME, CONVALESCENT HOME, HOSPITAL, NURSING FACILITY, OR A SIMILAR
INSTITUTION;
(II) IS CONFINED TO THE HOME OF THE INDIVIDUAL BY REASON OF
AGE, PHYSICAL OR MENTAL INFIRMITY, SICKNESS, PHYSICAL DISABILITY, OR FOR
ANY OTHER REASON;
(III) IS DECEASED AND IN A FUNERAL ESTABLISHMENT; OR
(IV) IS CONFINED IN A HOSPICE FACILITY.
(3) A LICENSED COSMETOLOGIST MAY PRACTICE COSMETOLOGY IN THE
SETTINGS SPECIFIED IN PARAGRAPH (2) OF THIS SUBSECTION IF THE
COSMETOLOGIST:
(I) COMPLIES WITH THE SAFETY, SANITATION, AND RECORD
KEEPING REGULATIONS OF THE BOARD; AND
(II) HAS PERSONAL LIABILITY INSURANCE.
(4) THE BOARD MAY ADOPT REGULATIONS NECESSARY TO CARRY OUT
THIS SUBSECTION.
[(2)](C) An individual who holds a limited license to provide manicuring
services may provide manicuring services in a barbershop.
