AN ACT concerning
Health Maintenance Organizations - Reimbursement for Medical Screening,
Assessment, and Stabilization Services
FOR the purpose of providing for the continuation of a provision that requires a
health maintenance organization to reimburse hospital emergency facilities and
health care providers for certain medical screening, assessment, and
stabilization services by repealing a termination provision relating to this
requirement; and generally relating to health maintenance organizations;
hospital emergency facilities, and health care providers.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

19-712.5.
(c) A health maintenance organization shall reimburse a hospital emergency
facility and provider, less any applicable co-payments, for medical screening,
assessment, and stabilization services rendered to meet the requirements of- the
Federal Emergency Medical Treatment and Active Labor Act.
SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

SECTION 4. AND BE IT FURTHER ENACTED, That this Act is an emergency
measure, is necessary for the immediate preservation of the public health and safety,
has been passed by a yea and nay vote supported by three-fifths of all the members
elected to each of the two Houses of the General Assembly, and shall take effect from
the date it is enacted. [At the end of July 1, 1999, with no further action required by
the General Assembly, Section 1 of this Act shall be abrogated and of no further force
and effect.]
