(A) The indicated amounts of appropriations are contingent on receipt of funds
resulting from the settlement of the State of Maryland v. Phillip Morris, et al
litigation.

(B) The indicated appropriations shall be reduced on a pro-rata basis to the
extent that payments actually received under the settlement are less than $54,260,968.

(C) It is the intent of the General Assembly that the Governor shall provide
fiscal 2000 deficienc
y appropriations in the budget submitted at the 2000 Session to
replace any amounts reduced or allotments withheld pursuant to Subsection (B) of the

Section as of January 1, 2000.

SECTION 38. AND BE IT FURTHER ENACTED, That:

(1) For the purpose of reducing funds currently budgeted for
contractual salaries and benefits in recognition of the days during the year
contractual employees are not paid due to holidays and absence from work
due to illness, and to reduce other excess funds, appropriations in this budget
shall be reduced as provided for in this section;

(2) The Governor shall develop a schedule for allocating the
indicated reduction to programs of the executive department and take such
actions as may be required to implement the reduction under Section 7-213 of
the State Finance and Procurement Article;

(3) Aggregate reductions under this section shall equal at least
the amounts indicated for the department and budgetary fund types listed:

Department Fund Amount

Executive General 8,000,000

Executive Special 2,250,000

Executive Federal 2,250,000

Total 12,500,000

SECTION 20. 39. 40. AND BE IT FURTHER ENACTED, That numerals of
this bill showing subtotals and totals are informative only and are not actual
appropriations. The actual appropriations are in the numerals for individual items of
appropriation. It is the legislative intent that in subsequent printings of the bill the
numerals in subtotals and totals shall be administratively corrected or adjusted for
continuing purposes of information, in order to be in arithmetic accord with the
numerals in the individual items.

SECTION 21. 40. 41. AND BE IT FURTHER ENACTED, That pursuant to the
provisions of Article III, Section 52(5a) of the Constitution of Maryland, the following
total of all proposed appropriations and the total of all estimated revenues available
to pay the appropriations for the 2000 fiscal year is submitted:
