(d) (2) (i) If the remaining term of confinement of the inmate exceeds [6]
12 months, the court that committed the inmate may designate the Division of
Correction as the agency of custody.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1999.

AN ACT concerning

Explosives - Forfeiture of Vehicle, Vessel, or Aircraft

FOR the purpose of adding the State as a governmental body eligible to receive
certain forfeited property; clarifying the jurisdiction to which a court must order
forfeiture; allowing the Secretary of the State Police to dispose of certain
forfeited property in a certain manner; providing for the deposit of certain cash
or money in the State general fund; and generally relating to the forfeiture of
vehicles, vessels, or aircraft.

BY repealing and reenacting, with amendments,

Article 38A - Fires and Investigations 

Section 34F
Annotated Code of Maryland

(1997 Replacement Volume and 1998 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 38A - Fires and Investigations

34F.

In addition to any other fines or penalties provided for a violation of the
provisions of this subtitle, any motor vehicle or other vehicle, vessel, or aircraft used
or employed in the concealment, conveying or transporting of any explosives during
the course of any violation of this subtitle by any person or persons on whom a penalty
and/or fine is imposed under the provisions of § 34A or § 34B OF THIS SUBTITLE, shall
upon the conviction or convictions be declared by the court to be forfeited to the
[county or to Baltimore City,] STATE, TO THE COUNTY, OR TO BALTIMORE CITY as the
case may be
BASED ON WHICH JURISDICTION INITIATED THE INVESTIGATION;
provided that no vehicle shall be forfeited hereunder unless the owner thereof
authorized or permitted such use or employment, and provided further that the
interest thereby transferred to the [county or Baltimore City] STATE, COUNTY, OR
