1997 LAWS OF MARYLAND

(IV) THAT THE APPLICANT HAS A SURPLUS, AS DEFINED IN § 14-117
OF THIS SUBTITLE, OF THE GREATER OF:

1. $100,000; AND

2. AN AMOUNT EQUAL TO THAT REQUIRED UNDER § 14-117

OF THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 355(b).

In item (2)(i) of this section, the phrase "in good faith" is substituted for the
former archaic phrase "bona fide".

In item (2)(ii)2 of this section, the word "licensed" is added to modify
"chiropractor" because chiropractors are required to be licensed under Title 3
of the Health Occupations Article.

Also in item (2)(ii)2 of this section, the references to "podiatric ... services"
and to a "podiatrist" are substituted for the former obsolete references to
"chiropodial ... service" and to a "chiropodist".

Also in item (2)(ii)2 of this section, the reference to a "licensed physician" is
substituted for the former reference to a "doctor of medicine" for conformity
with terminology used elsewhere in this article. See, e.g., § 15-713 of this
article.

As to the deletion of the former reference to "license" in the introductory
language of this section, see the General Revisor's Note to this subtitle.

14-111. SCOPE OF CERTIFICATE OF AUTHORITY.

A CERTIFICATE OF AUTHORITY ISSUED UNDER THIS SUBTITLE AUTHORIZES A
CORPORATION TO ISSUE CONTRACTS IN THE FORM FILED WITH THE COMMISSIONER
TO PERSONS THAT BECOME SUBSCRIBERS TO THE PLAN.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 355(c).

The former phrase "until expiration or revocation thereof, which modified
"certificate of authority", is deleted as implicit in the requirement that a
corporation have a certificate of authority issued under this subtitle.

As to the deletion of the former reference to "license", see the General
Revisor's Note to this subtitle.
