Ch. 35

(E) ADMINISTRATION.

(1) THE STATE TREASURER IS THE CUSTODIAN OF THE FUND.

(2) THE FUND SHALL BE INVESTED AND REINVESTED IN THE SAME
MANNER AS STATE FUNDS.

(3) THE STATE TREASURER SHALL DEPOSIT PAYMENTS RECEIVED
FROM THE COMMISSIONER INTO THE FUND.

(F) STATUS AS TO GENERAL FUND.

(1) THE FUND IS A CONTINUING, NONLAPSING FUND AND IS NOT
SUBJECT TO § 7-302 OF THE STATE FINANCE AND PROCUREMENT ARTICLE, AND MAY
NOT BE DEEMED A PART OF THE GENERAL FUND.

(2) NO PART OF THE FUND MAY REVERT OR BE CREDITED TO:

(I) THE GENERAL FUND OF THE STATE; OR

(II) A SPECIAL FUND OF THE STATE.

2- 408. REPORT BY ATTORNEY GENERAL.

THE OFFICE OF THE ATTORNEY GENERAL SHALL REPORT TO THE FRAUD
DIVISION ON EACH CASE NOT PROSECUTED AND THE REASONS WHY THE CASE WAS
NOT PROSECUTED.

REVISOR'S NOTE: This section formerly was Art. 48A, § 233AD.

The only changes are in style.

SUBTITLE 2. RECIPROCAL INSURERS.

3- 201. "SUBSCRIBER" DEFINED.

IN THIS SUBTITLE, "SUBSCRIBER" MEANS A PERSON THAT EXCHANGES A
MUTUAL AGREEMENT OF INDEMNITY WITH OTHER PERSONS THROUGH A COMMON
ATTORNEY IN FACT.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 277, as it described subscribers.

The reference to a "mutual" agreement is substituted for the former reference
