1997 LAWS OF MARYLAND

(C) COMPENSATION.

THE ASSOCIATE COMMISSIONER OF THE FRAUD DIVISION IS UNCLASSIFIED
AND IS ENTITLED TO ANNUAL COMPENSATION AS PROVIDED IN THE STATE

BUDGET.

(D) RESPONSIBILITIES.

THE ASSOCIATE COMMISSIONER OF THE FRAUD DIVISION IS RESPONSIBLE FOR
THE OPERATION OF THE FRAUD DIVISION AND THE EXERCISE OF ALL AUTHORITY
GRANTED TO THE FRAUD DIVISION UNDER THIS ARTICLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 48A, § 233AB(b) and (c).

2-404. STATE POLICE TO WORK WITH FRAUD DIVISION.

THE COMMISSIONER SHALL REQUEST THE SECRETARY OF STATE POLICE TO
ASSIGN ONE OR MORE STATE POLICE OFFICERS TO WORK IN COORDINATION WITH
THE FRAUD DIVISION.

REVISOR'S NOTE: This section formerly was Art. 48A, § 233AB(d).

The only change is in style.

2-105. GENERAL POWERS AND DUTIES OF FRAUD DIVISION.
THE FRAUD DIVISION:

(1) HAS THE AUTHORITY TO INVESTIGATE EACH PERSON SUSPECTED
OF ENGAGING IN INSURANCE FRAUD;

(2) IF APPROPRIATE AFTER AN INVESTIGATION:

(I) SHALL REFER SUSPECTED CASES OF INSURANCE FRAUD TO
THE OFFICE OF THE ATTORNEY GENERAL OR APPROPRIATE LOCAL STATE'S
ATTORNEY TO PROSECUTE THE PERSON CRIMINALLY FOR INSURANCE FRAUD;

(II) SHALL NOTIFY THE APPROPRIATE PROFESSIONAL LICENSING
BOARD OR DISCIPLINARY BODY OF EVIDENCE OF INSURANCE FRAUD THAT
INVOLVES PROFESSIONALS; AND

(III) SHALL NOTIFY THE APPROPRIATE PROFESSIONAL LICENSING
BOARD OF EVIDENCE OF GROSS OVERUTILIZATION OF HEALTH CARE SERVICES;
