(1) NO FURTHER PROOF OF THE AUTHORITY OF THE OFFICER TO ACT
IS REQUIRED; AND

(2) THE ACTION OF THE COMMISSIONED OFFICER IS PRIMA FACIE
EVIDENCE THAT THE PERSON MAKING THE OATH OR ACKNOWLEDGMENT IS
COVERED BY THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived without substantive
change from former Art. 18, § 15(d).

In item (2) of this section, the phrase "covered by this subtitle" is substituted
for the former phrase "within the purview of this section" to reflect that
former Art. 18, § 15(d) is revised as this subtitle.

SUBTITLE 3. VALIDATION OF PRIOR ACKNOWLEDGMENTS.
19-301. VALIDATION OF PRIOR ACKNOWLEDGMENTS.

ANY LEGAL INSTRUMENT THAT WAS PROPERLY ACKNOWLEDGED WITHIN THE
2 YEARS DIRECTLY PRECEDING JUNE 1, 1953 IN ACCORDANCE WITH THE LAWS AND
PRACTICES THAT EXISTED AT THAT TIME MAY NOT BE CONSTRUED TO BE
DEFECTIVE OF WRONGFULLY ACKNOWLEDGED BY REASON OF ANY PROVISION OF
CHAPTER 404, ACTS OF 1953, BUT SHALL BE CONSTRUED AND TREATED AS PROPERLY
ACKNOWLEDGED FOR ALL OF THE PURPOSES OF THAT CHAPTER.

change from former Art. 18; § 16.

Article - State Personnel and Pensions

Subtitle 4. Miscellaneous Benefits [in Executive Branch].

10-401.

(a) Except as provided in subsection (b) of this section AND § 10-404 OF THIS
SUBTITLE, this subtitle applies to all employees of all units in the Executive Branch of
State government.

(b) [This] EXCEPT AS PROVIDED IN § 10-404 OF THIS SUBTITLE, THIS subtitle
does not apply to a unit with an independent personnel system.

10-404. DEATH BENEFITS FOR SURVIVORS OF STATE EMPLOYEES.
(A) DEFINITIONS.

(1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

(2) "CHILD" MEANS ANY NATURAL, ADOPTED, OR POSTHUMOUS CHILD,
OR STEPCHILD, OF THE DECEDENT WHO IS:

(I) 18 YEARS OF AGE OR UNDER; OR
