(3)     At the end of a term, a member continues to serve until a successor is
appointed and qualifies.

(4)     A member who is appointed after a term has begun serves only for the
rest of the term and until a successor is appointed and qualifies.

(5)     To the extent practicable, the Governor shall fill any vacancy on the
Board within 60 days of the date of the vacancy.

(6)     A member may not serve more than 2 consecutive full terms.

(g) (1) The Governor may remove a member for incompetence or misconduct.

(2) Upon the recommendation of the Secretary, the Governor may remove a
member whom the Secretary finds to have been absent from 2 successive Board meetings
without adequate reason.

. SECTION 2. AND BE IT FURTHER ENACTED, That nothing in this Act may
be construed to affect the term of any member of the State Board of Pharmacy who is
serving on the Board on the effective date of this Act.

SECTION 3. AND BE IT FURTHER ENACTED, That the Governor, in making
the four initial professional member appointments to the State Board of Pharmacy
authorized under § 12-202(a) of the Health Occupations Article, as enacted by Section 1
of this Act, may stagger those appointments and determine the associational groups from
which those appointments are to be made.

SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1997.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 728.

This bill prohibits a licensed cigarette manufacturer, or person connected with the
business of a licensed manufacturer or related by ownership, from simultaneously holding
a financial interest in a wholesaler license or in any wholesaler's business. The bill also
prohibits a licensed cigarette wholesaler, or person connected with the business of a
licensed wholesaler or related by ownership, from simultaneously holding a financial
interest in a manufacturer license or in any manufacturer's business.

House Bill 1006, which was passed by the General Assembly and signed by me on this
date, accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 728.
