2. With another individual personally committed to the
treatment of the individual who has permanently lost kidney function] AN END STAGE
RENAL DISEASE CLINIC CERTIFIED UNDER MEDICARE; and

(4) In compliance with the rules and regulations adopted by the Board
under this section.

(i) Subject to the Administrative Procedure Act, the Board may suspend or
revoke the home [hemodialysis] DIALYSIS distribution permit of any home
[hemodialysis] DIALYSIS distribution permit holder who fails to comply with subsection
(h) of this section.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
June 1, 1997.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 437.

This bill prohibits a health care practitioner from referring a patient, or directing an
employee to refer a patient, to a health care facility in which the practitioner's immediate
family has a beneficial interest of 3% or more.

House Bill 661, which was passed by the General Assembly and signed by me on April 29,
1997, accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 437.

AN ACT concerning

Health Occupations - Patient Referrals

FOR the purpose of altering a certain provision of law that prohibits health care
practitioners from referring patients to health care entities in which the health care
practitioners' immediate family owns a beneficial interest; and generally relating to
the referral of patients by health care practitioners to health care entities.

BY repealing and reenacting, with amendments,
