VETOES

12-502.

(a)     A person who willfully or knowingly violates this title is guilty of a
misdemeanor and, on conviction, is subject to a fine not exceeding [$5,000] $10,000 or
imprisonment not exceeding [1 year] 2 YEARS or both.

(b)     Each associate, employee, manager, or partner who participates in or consents
to a violation of this title is guilty of a misdemeanor and, on conviction, is subject to a fine
not exceeding $5,000 or imprisonment not exceeding 1 year or both.

(c)     Each violation of this title is a separate offense.

SECTION 2. AND BE IT FURTHER ENACTED, That § 12-209(a)(2)(vi) of
the Business Regulation Article, as enacted by this Act, shall be construed only
prospectively and may not be applied or interpreted to have any effect on or application
to licensees or license applicants for employees hired before the effective date of this Act.

SECTION 2. 3. AND BE IT FURTHER ENACTED, That this Act shall take
effect October 1, 1997.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 419.

This bill exempts from the disclosure requirements under the Ethics Law a lobbyist's gift
to that lobbyist's immediate family. The gift must be personal and private in nature and
must not be related to lobbying activities.

House Bill 1262, which was passed by the General Assembly and signed by me on April 8,
1997, accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 419.
