Dear Mr. President:
In accordance with Article II, Section 17 of the Maryland Constitution, I have today
vetoed Senate Bill 28.
This bill authorizes the chief officer of a correctional facility and the director of the
Patuxent Institution to authorize medical treatment for a juvenile inmate, and establishes
the circumstances for the exercise of that authority. In addition, the bill provides that no
liability may attach to the good faith exercise of this authority.
House Bill 355, which was passed by the General Assembly and signed by me on May 8,
1997, accomplishes the same purpose. Therefore, it is not necessary for me to sign Senate
Bill 28.

AN ACT concerning
State and Local Correctional Detention Facilities - Authorising Authorization for
Medical Treatment of Juvenile Inmates
FOR the purpose of authorizing the warden or administrator of a State or local detention
facility and a designee of a warden or administrator, to authorize medical treatment
of a juvenile inmate; authorizing medical treatment of a juvenile inmate when in the
warden's or administrator's judgment such treatment is required and a parent,
guardian, or person in loco parentis of the juvenile is not available to give
authorization; establishing that no liability shall attach to the warden or
administrator for authorizing medical treatment in good faith; defining certain
terms; and generally relating to medical treatment of juveniles inmates.
FOR the purpose of authorizing certain officers of certain correctional facilities, on the
recommendation of a health care provider, to authorize medical treatment of a juvenile
inmate of a correctional facility under certain circumstances; specifying that liability may
not attach to certain officers of certain correctional facilities for authorizing medically
necessary treatment of a juvenile inmate under certain circumstances; defining a certain
term; and generally relating to the authorization for medical treatment of juvenile
inmates in correctional facilities.
