Ch. 758                                        1997 LAWS OF MARYLAND

(i) not less than $1,000,000 for reduction of State debt authorized
under the Outdoor Recreation Land Loan of 1969; and

(ii) the remainder not allocated under item (i) of this paragraph shall
be allocated as follows:

1.        84.2% in the State budget for the purposes specified in Title
5, Subtitle 9 of the Natural Resources Article (Program Open Space);

2.        13.2% in the State budget for the Agricultural Land
Preservation Fund established under § 2-505 of the Agriculture Article; and

3.        2.6% in the State budget for the Heritage Conservation Fund
established under Title 5, Subtitle 15 of the Natural Resources Article.

(6) FOR THE FISCAL YEAR COMMENCING JULY 1, 1997 AND FOR EACH
SUBSEQUENT FISCAL YEAR
, 90% OF THE BALANCE SHALL BE ALLOCATED AS
PROVIDED UNDER SUBSECTION (D) OF THIS SECTION AND 10% SHALL BE
ALLOCATED AS FOLLOWS:

(I) 30% 60% TO THE RURAL LEGACY PROGRAM ESTABLISHED
UNDER TITLE 5, SUBTITLE 9A OF THE NATURAL RESOURCES ARTICLE.; AND

(II) 40% TO THE AGRICULTURAL LAND PRESERVATION FUND
ESTABLISHED UNDER § 2-205 OF THE AGRICULTURE ARTICLE; AND.

(7) FOR THE FISCAL YEAR COMMENCING JULY 1, 1998 AND FOR EACH
SUBSEQUENT FISCAL YEAR, 90% OF THE BALANCE SHALL BE ALLOCATED AS PROVIDED
UNDER SUBSECTION (D) OF THIS SECTION AND 10% SHALL BE ALLOCATED AS FOLLOWS:

(I) 50% TO THE RURAL LEGACY PROGRAM ESTABLISHED UNDER
TITLES, SUBTITLE 9A OF THE NATURAL RESOURCES ARTICLE;

(II) 40% TO THE AGRICULTURAL LAND PRESERVATION FUND
ESTABLISHED UNDER § 2-205 OF THE AGRICULTURE ARTICLE; AND

(III) 30% 10% TO PROGRAM OPEN SPACE, FOR LAND ACQUISITION
AS SPECIFIED IN § 5-903(A)(2) OF THE NATURAL RESOURCES ARTICLE.

SECTION 2. AND BE IT FURTHER ENACTED, That, to the extent provisions of
this Act provide for an allocation of funds different from that provided for in the Budget Bill,

Chapter __ of the Acts of 1997 (H.B. 175), it is the intent of the General Assembly that the

allocation provided under this Act shall control. The Governor is hereby authorized to transfer
funds by approved budget amendment to the extent required to effect the fund allocation
provided under this Act.

SECTION 3. AND BE IT FURTHER ENACTED, That the terms of the initial
members of the Advisory Committee to the Rural Legacy Board shall expire as follows:

(1)     4 members in 2000;

(2)     4 members in 2001; and

(3)     3 members in 2002.
