(4) PROCEDURES FOR FILLING A VACANCY ON A BOARD;

(5) THE REMOVAL OF BOARD MEMBERS; AND                       

(6) PROCEDURES TOR DETERMINING IF A PERSON IS A SEXUALLY
VIOLENT PREDATOR.

(E) WHEN REQUESTED BY A COURT, A BOARD SHALL DETERMINE IF A
PERSON IS A SEXUALLY VIOLENT PREDATOR UNDER § 792B OF ARTICLE 27 OF THE
CODE.

(F) A MEMBER OF A BOARD MAY RECEIVE COMPENSATION FOR THE
MEMBER'S SERVICES.

SECTION 2. AND BE IT FURTHER ENACTED, That the Department of Public
Safety and Correctional Services
shall conduct public education and awareness programs
to inform the public of its ability to obtain information regarding a sexually violent
predator under this Act.

SECTION 3. AND BE IT FURTHER ENACTED. That the Court of Appeals shall
adopt rules governing the determination of sexually violent predators.

SECTION 1. AND BE IT FURTHER ENACTED, That nothing in this Act shall
be
construed to impose a duty on a licensed real estate broker, licensed real estate
associate broker, or licensed real estate salesperson to disclose information concerning a
sexual offender or sexually violent predator who is required to register under this Act.
The identity of or fact that a sexual offender or sexually violent predator who is required
to register under this Act resides or works in a community is not a material fact required
to be disclosed by a real estate licensee under Title 17 of the Business Occupations and
Professions Article.

SECTION 3. 5. AND BE IT FURTHER ENACTED, That this Act shall be
construed
only prospectively to apply to offenses that are committed after October 1,
1997, and may not be applied or interpreted to have any effect on or application to any
individual who commits an offense before October 1, 1997.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF MARYLAND.
That Section(s) 792(b), (d), (e), (f), (g), (h), (i), (j), and (k), respectively, of Article 27 -
Crimes and Punishments of the Annotated Code of Maryland be renumbered to be Section(s)
792(e), (f), (e), (h), (d), (i), (j), (k), and (l), respectively.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland read as
follows:

Article 27- Crimes and Punishments

792.

(a) (I) In this section the following words have the meanings indicated.
(2) "Child sexual offender" means a person who:
