23-404.

(c) A member qualifies for a normal service retirement allowance under
subsection (b) of this section if the member:

(3)     (ii) has been in the unclassified service [of] OR ITS EQUIVALENT IN
the State continuously from June 30, 1982, until separating from employment; and

30-301.

An individual is eligible to participate in the program if the individual is eligible for
membership in a retirement system or a pension system and is:

(4)     an employee of Morgan State University who is not subject to the
provisions of DIVISION I OF the State Personnel and Pensions Article [that govern the
classified service]; or

35-204.

(c) (3) (i) Except as provided in subparagraph (ii) of this paragraph or
otherwise by law, employees of the Board are [in the classified service and are] subject
to the provisions of Division I of this article that govern [classified service]
NONTEMPORARY employees.

(ii) Employees of the Board whose labor is predominately intellectual
and who hold positions that the Board designates as professional or technical positions
involving specialized skill, education, and knowledge are in the [unclassified service]
EXECUTIVE SERVICE, MANAGEMENT SERVICE, OR ARE SPECIAL APPOINTMENTS OF
THE SKILLED SERVICE OR THE PROFESSIONAL SERVICE IN THE STATE PERSONNEL
MANAGEMENT SYSTEM.

Article - Tax - Property

2-104.

(c) The State Supervisor of Assessments and the assessment area supervisors are
in the [ unclassified] MANAGEMENT service of the State Personnel Management System.
However, they shall hold their positions during good behavior and may be removed from
their positions only after a hearing before the Department and a finding of incompetency
or other cause.

2-105.

(b) (2) Each supervisor:

(ii) shall be in the [ unclassified] MANAGEMENT service of the State
Personnel Management System.

(d) (3) Except as otherwise provided by law, the Secretary shall appoint and
remove all other personnel in accordance with:
