(d) An individual is not eligible for the home detention program if the individual:

The Commissioner and General Manager shall develop programs of occupational
experiences to complement the manpower development plans of the State Department of
Education and other agencies serving the residents of Division of Correction institutions.
In this function, the Commissioner and General Manager shall consult with the following
individuals who shall be responsible to provide appropriate assistance:

(3) The Assistant Secretary, Division of Employment and Training,
Department of Business and Economic Development; AND

[(a)]The correctional and reformatory institutions under the Department of
Correction are:

[(b)](l) The Maryland Penitentiary.

[(c)](2) The Maryland House of Correction.

[(d)](3) The Maryland Correctional Institution — Hagerstown, which is a place
of confinement and training for male offenders from sixteen (16) to twenty-five (25) years
of age, both inclusive. In those cases in which the judge of the Circuit Court for Baltimore
City, who is assigned to exercise jurisdiction in juvenile causes, may waive jurisdiction and
order a minor under the age of sixteen, and the judge of any circuit court in any county
exercising jurisdiction in juvenile causes, may waive jurisdiction and order a minor under
the age of eighteen, to be held for action under the regular procedure that would follow
if such act or acts had been committed by an adult, then and in that event the judge
presiding in the circuit court of any county upon assuming jurisdiction in such case and
upon conviction may commit the minor to the Maryland Correctional Institution —
Hagerstown regardless of age. The courts of this State, instead of imposing sentences of
fixed duration upon male offenders included within this subsection may sentence them to
the Maryland Correctional Institution — Hagerstown for an indeterminate period of time
