Baltimore City; exempting Class C beer, wine and liquor licenses issued for use on a
certain premises in Baltimore City from certain prohibitions relating to the issuance and
transfer of alcoholic beverages licenses; providing for the effective dates of the provisions
of this Act; and generally relating to alcoholic beverages in Baltimore City.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 8-302 through 8-304.1 and 8-305 through 8-311,
respectively, of Article 2B - Alcoholic Beverages of the Annotated Code of Maryland be
renumbered to be Section(s) 8-303 through 8-313, respectively.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of Maryland
read as follows:

Article 2B — Alcoholic Beverages

8-302.

(A)    THE BALTIMORE CITY BOARD OF LICENSE COMMISSIONERS MAY ISSUE A
SPECIAL BALTIMORE WINE FESTIVAL (BWF) LICENSE.

(B)     NOTWITHSTANDING ANY OTHER PROVISION OF LAW, AN APPLICANT FOR
A SPECIAL BWF LICENSE SHALL BE A HOLDER OF AN EXISTING STATE RETAIL
ALCOHOLIC BEVERAGES LICENSE, STATE CLASS 3 WINERY LICENSE, OR STATE
CLASS 4 WINERY LICENSE ISSUED UNDER THIS ARTICLE.

(C) (1) ON RECEIPT OF AN APPLICATION FOR A LICENSE UNDER THIS SECTION,
THE BOARD SHALL SEND WRITTEN NOTICE TO ALL COMMUNITY GROUPS THAT ARE
LOCATED WITHIN A ONE-HALF MILE RADIUS OF THE PROPOSED LOCATION FOR THE
FESTIVAL AS INDICATED IN THE COMMUNITY REGISTRY AT THE DEPARTMENT OF

PLANNING.
