(h) (1) Except as provided in [§ 4-401(8)] § 4-401(9) of the Courts and Judicial
Proceedings Article, all proceedings under this section shall be instituted in the circuit
court by the appropriate forfeiting authority.

(g) "Humane method" means either: (1) A method whereby the animal is
rendered insensible to pain by mechanical, electrical, chemical or other means that is
rapid and effective, before being shackled, hoisted, thrown, [ case] CAST, or cut; or (2)
a method in accordance with ritual requirements of the Jewish faith or any other religious
faith, whereby the animal suffers loss of consciousness by anemia of the brain caused by
simultaneous and instantaneous severance of the carotid arteries with a sharp instrument.
The use of a manually operated hammer, sledge or poleax during slaughtering operations
is specifically declared to be an inhumane method of slaughter within the meaning of this
subtitle.

(b) A person commits the offense of theft when he willfully or knowingly uses
