(2) A person not required to take an examination shall pay the applicable
license fee prescribed in [§ 41(8)(i) or (ii)] § 41 of this article.
(3) To renew an insurance adviser's license, a licensee shall submit to the
Commissioner:
(i) A renewal application in the form prescribed by the
Commissioner; and
(ii) The biennial license renewal fee prescribed by [§ 41(8)(iii)] § 41
of this article.
233A.
(a) In this section and §§ 233AB through 233D of this subtitle, inclusive, the
following words have the meanings indicated.
(B) "ACCOUNT" MEANS THE INSURANCE FRAUD DIVISION ACCOUNT.
[(b)](C) "Fraud Division means the Insurance Fraud Division of the Maryland
Insurance Administration.
[(c) "Fund" means the Insurance Fraud Division Fund.]
(d) "Insurance fraud" means:
(1) A violation of § 233 of this article;
(2) Theft, as set out under Article 27, §§ 340 through 342 of the Code;
(i) From a person regulated under this article; or
(ii) By a person regulated under this article or by any officer, director,
agent, or employee of any person regulated under this article; or
(3) Any other fraudulent activity set out under Article 27 of the Code that is
committed by or against a person regulated under this article.
233AE.
Funding for the Fraud Division shall be as provided in the State budget.
233AF.
(a) There is an Insurance Fraud Division [Fund]—ACCOUNT.
(b) The purpose of the [Fund] ACCOUNT is to pay all the costs and expenses
incurred by the Insurance Administration related to the operation of the Insurance Fraud
Division, including the costs of State employees specifically assigned to the Fraud
Division by the Office of Attorney General and the Maryland State Police.
(c) The [Fund] ACCOUNT shall consist of;
(1) [The fees] THAT PORTION OF THE REGULATION FEE collected and
deposited in the [Fund] ACCOUNT by the Commissioner under [§ 640B] § 41D(C) of this
article; and
