(5)     § 12-703 ("Operating a pharmacy without permit"); and

(6)     § 12-704 ("Misrepresentations").

(c)     Each day that a violation of any section of Subtitle 4 of this title continues
constitutes a separate offense.

(d)     Within 10 days after a court renders the conviction, the court shall report to
the Board each conviction of a pharmacist for:

(1)     Any crime [respecting] REGARDING the pharmacy or drug laws that
involves professional misconduct; or

(2)     Any crime that involves the State law regarding controlled dangerous
substances or the federal narcotic laws.

(E) (1) ANY PERSON WHO VIOLATES § 12-701 ("PRACTICING PHARMACY
WITHOUT A LICENSE") OR § 12-703 ("OPERATING A PHARMACY WITHOUT A PERMIT")
OF THIS SUBTITLE IS SUBJECT TO A CIVIL FINE OF NOT MORE THAN $50,000 TO BE
ASSESSED BY THE BOARD.

(2) THE BOARD SHALL PAY ANY PENALTY COLLECTED UNDER THIS
SUBSECTION INTO THE STATE BOARD OF PHARMACY FUND.

SECTION 2. AND BE IT FURTHER ENACTED, That §§ 12-313(b)(15), (16),
(26), and (27) ,12-409(b), and 12-707(a)(4) of the Health Occupations Article, as enacted
by Section 1 of this Act, shall take effect October 1, 1997, contingent on the taking effect

of Chapter____ (H.B.____)(71rl757) of the Acts of the General Assembly of 1997, and

if Chapter ____ does not become effective, §§ 12-313(b)(15), (16), (26), and (27),

12-409(b), and 12-707(a)(4) of the Health Occupations Article, as enacted by Section 1
of this Act, shall be null and void without the necessity of further action by the General
Assembly.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1997.

Lead Poisoning Prevention Program - Alteration of Deadlines and Other Dates

FOR the purpose of altering the dates by which certain rental dwelling units must be
registered under the Lead Poisoning Prevention Program; altering the dates by
which and until which certain fees must be paid for certain rental dwelling units;
altering certain deadlines for meeting certain risk reduction standards; altering
certain dates by which certain information must be given to certain persons under
