(2) For purposes of this subsection, a failure to pay does not include a
nonpayment or underpayment of a fee that is promptly remedied following written
notification from the Commissioner of the nonpayment or underpayment.]

[(f)] (E) The Commissioner may waive, by rule, order, or otherwise, the filing of
any document required under this section.

SECTION 4. AND BE IT FURTHER ENACTED, That Section 3 of this Act shall
take effect October 10, 1999.

SECTION 5. AND BE IT FURTHER ENACTED, That § 11-103 of the
Corporations and Associations Article shall apply the Philanthropy Protection Act of
1995 and shall apply to administrative and judicial proceedings beginning after the
effective date of this Act.

SECTION 6. AND BE IT FURTHER ENACTED, That, except for Section 3 of
this Act, this Act shall take effect October 1, 1997.

AN ACT concerning

State Board of Pharmacy - Scope of Practice

FOR the purpose of altering certain provisions of the Maryland Pharmacy Practice Act
concerning licensing, permits, the practice of pharmacy, the operation of
pharmacies, and the regulation of drugs, and devices, and diagnostics; specifying the
scope of the Act; requiring a person to have a license to practice pharmacy;
specifying the qualifications and application procedure for obtaining a certain
license and the scope of the license; specifying the standards applicable to a
pharmacy to which a certain permit has been issued, including a nonresident
pharmacy; authorizing a certain inspection or investigation of pharmacies by certain
State officials and prohibiting a person from hindering that inspection or
investigation; providing certain standards concerning certain pharmacy practices
relating to drugs, and devices; or diagnostics; specifying certain powers and duties of
the State Board of Pharmacy; defining certain terms; and generally relating to the
practice of pharmacy and the Maryland Pharmacy Practice Act.
