(1) Any disclosure of a record by the Board to any of its investigatory
bodies; or
(2) A licensee, certificate holder, or registration holder who has been
charged under this title or a party to a proceeding before the Board who claims to be
aggrieved by the decision of the Board.
[(p)](Q) If any information contained in any medical or hospital document or any
other exhibit is otherwise open for disclosure under law, the use of that document or
exhibit in any record of the Board or any of its investigatory bodies does not prevent its
disclosure in any other proceeding.
SECTION 2. AND BE IT FURTHER ENACTED, That it is the intent of the
General Assembly that the change to § 14-404(a)(38) of the Health Occupations Article
made by this Act may not impair a licensed physician from legitimately preparing for an
action before the State Board of Physician Quality Assurance.
SECTION 3. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1997.

AN ACT concerning
Baltimore City - Alcoholic Beverages
(Hours and Days for Sale)
FOR the purpose of expanding the authority of the Baltimore City Board of License
Commissioners to restrict, by regulation, the hours and days for the sale and
consumption of alcoholic beverages to include the entire City; requiring the Board
to have cause in order to restrict, by regulation, the hours and days for the sale and
consumption of alcoholic beverages authorizing the Board of License Commissioners
for Baltimore City to petition the Circuit Court for a certain order restricting the hours
and days for the sale and consumption of certain alcoholic beverages on certain licensed
premises under certain circumstances; requiring the Circuit Court to make certain
findings before issuing the order; limiting the duration of the Circuit Court's order;
providing that the Circuit Court's order is stayed under certain circumstances; providing
for the construction of a certain provision of law; and generally relating to the
Baltimore City Board of License Commissioners and the sale and consumption of
alcoholic beverages in Baltimore City.

Section 11-301, 11-302, and 11-303, and 11-305
