(II) THE PROGRAM APPROVES THE WITHDRAWAL.
(II) THE PROGRAM SHALL TRANSFER TO THE ESTATE OF A DECEASED
RECIPIENT:
(1) ANY FUNDS EXCEEDING THE MEDICAL ASSISTANCE EXPENDITURES
TO BE REIMBURSED TO THE PROGRAM AND FUNERAL EXPENSES AS PROVIDED
UNDER SUBSECTION (E) OF THIS SECTION WHEN A PERSONAL REPRESENTATIVE
APPOINTED FOR THE ESTATE OF THAT PERSON REQUESTS THOSE FUNDS; OR
(2) ANY AMOUNTS WITHDRAWN UNDER SUBSECTION (A) OF THIS
SECTION, UPON RECEIPT OF AN AFFIDAVIT VERIFIED BY A PROGRAM
REPRESENTATIVE THAT THE DECEASED RECIPIENT HAD AT THE TIME OF DEATH A
SURVIVING SPOUSE, A SURVIVING CHILD LESS THAN 21 YEARS OF AGE, OR A
SURVIVING CHILD WHO WAS BLIND OR PERMANENTLY AND TOTALLY DISABLED.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect
October 1, 1997.

AN ACT concerning
Garrett County - Personal Property Tax - Modification
FOR the purpose of authorizing the governing body of Garrett County to reduce the
percent of the assessment on one or more classes or subclasses of specified personal
property; requiring the County to provide certain notice to the State Department of
Assessments and Taxation; providing that if notice is received by a specified date,
the change shall be effective as of a specified period; and generally relating to
authorization for the reduction of assessments on personal property in Garrett
County.
