CHAPTER 551
(Senate Bill 270)

AN ACT concerning

Baltimore City - Ordinance Enforcement - Proceedings and Penalties

FOR the purpose of authorizing Baltimore City to establish certain fines civil and criminal
fines and penalties
to enforce certain ordinances, rules, or regulations; authorizing
Baltimore
City to establish certain administrative proceedings, remedies, and
penalties to enforce certain Baltimore City ordinances relating to the sanitary

conditions of lots, buildings, and public property; providing appropriate judicial
review of orders or decisions of certain proceedings
providing for the effective date of
this Act,
and generally relating to the administration and authority of the Mayor and
City Council of Baltimore to provide civil and criminal fines and penalties for the
enforcement of ordinances, rules, or regulations in Baltimore City.

BY repealing and reenacting, with amendments,
The Charter of Baltimore City
Article II - General Powers
Section (48)

(1996 Edition, as amended)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

The Charter of Baltimore City

Article II - General Powers

The Mayor and City Council of Baltimore shall have full power and authority to
exercise all of the powers heretofore or hereafter granted to it by the Constitution of
Maryland or by any Public General or Public Local Laws of the State of Maryland; and in
particular, without limitation upon the foregoing, shall have power by ordinance, or such
other method as may be provided for in its Charter, subject to the provisions of said
Constitution and Public General Laws:

(48) (A) To provide CIVIL AND CRIMINAL FINES AND penalties for the violation
of any ordinance, rule or regulations established by the City under or in the execution of
any power granted by this Article II; provided that no fine OR PENALTY shall exceed
$1000.00 and no imprisonment shall be for a longer period than 12 months.

(B) TO ESTABLISH, BY ORDINANCE:

(1) SUBJECT TO PARAGRAPH (2) OF THIS SUBSECTION,
ADMINISTRATIVE PROCEEDINGS, REMEDIES, AND PENALTIES FOR THE

ENFORCEMENT OF ANY ORDINANCE RELATED TO THE SANITARY CONDITIONS OF
LOTS, BUILDINGS, AND PUBLIC PROPERTY, AND
