(2) The State Fire Prevention Commission shall review annually the fee
schedule adopted under this subsection to ensure that the moneys collected shall at least
cover the costs of administering plan review and conducting inspections.
(3) This subsection may not be construed to limit the authority of a local
authority to establish a fee schedule for plan review and inspections conducted by the
local authority.
(F) (1) IN THIS SECTION, "PERSON" MEANS AN INDIVIDUAL, RECEIVER,
TRUSTEE, GUARDIAN, PERSONAL REPRESENTATIVE, FIDUCIARY, REPRESENTATIVE
OF ANY KIND, PARTNERSHIP, FIRM, ASSOCIATION, CORPORATION, OR OTHER
ENTITY.
(2) THE STATE FIRE PREVENTION COMMISSION SHALL ADOPT
REGULATIONS THAT ESTABLISH A PROGRAM TO LICENSE AND REGULATE PERSONS
WHO INSTALL FIRE SPRINKLER SYSTEMS, INCLUDING PERSONS WHO ARE ENGAGED
IN THE DESIGN, INSTALLATION, INSPECTION, TESTING, REPAIR, OR MODIFICATION
OF ANY FIRE SPRINKLER SYSTEM IN ANY RESIDENTIAL OR COMMERCIAL BUILDING
IN THE STATE.
(2) (3) THE STATE FIRE PREVENTION COMMISSION SHALL
(I) LICENSE FIRE SPRINKLER CONTRACTORS;
(I) (II) ESTABLISH PROFESSIONAL AND TECHNICAL STANDARDS;
(II) (III) (II) ESTABLISH REQUIREMENTS FOR LIABILITY
INSURANCE;
(III) (IV) (III) ESTABLISH REQUIREMENTS FOR LICENSURE;
(IV) (V) (IV) ESTABLISH A REASONABLE LICENSING FEE
SCHEDULE OF FEES FOR LICENSES ISSUED UNDER THIS SECTION USING DOLLAR
AMOUNTS THAT WILL RECOVER BUT NOT EXCEED THE DIRECT AND INDIRECT COSTS
ASSOCIATED WITH THE ISSUANCE OF THE LICENSES.
(V) (VI) (V) DESIGNATE AND IDENTIFY EXEMPTIONS TO
REGULATIONS;
(VI) (VII) (VI) DEFINE SPRINKLER SYSTEM;, PROVIDED THAT
THERE IS NO CONFLICT WITH § 12-101(J) OF THE BUSINESS OCCUPATIONS AND
PROFESSIONS ARTICLE;
(VIII) (VII) DEFINE SPRINKLER CONTRACTOR; AND
(VII) (IX) (VIII) ESTABLISH PROCEDURES FOR THE STATE FIRE
MARSHAL TO DENY, REVOKE, OR SUSPEND A LICENSE OF ANY PERSON WHO FAILS
TO COMPLY WITH ANY REGULATION ADOPTED BY THE STATE FIRE PREVENTION
COMMISSION.
